Sapotek Inc. Privacy Policy
Scope
This Privacy Policy (the “Policy”) is intended to let you know how Sapotek uses your personal information when signing up to use Desktoptwo, Computadora.de or any other product or service developed by Sapotek (referred to collectively as “Services”).

This Policy does not apply to companies or organizations with which Sapotek is or may be affiliated informally (they may have their own privacy policies) or to anyone who is not a Sapotek employee, but it does apply to all Sapotek employees (all of whom have agreed to the terms of this Policy as well as other confidentiality and/or non-disclosure agreements), to third parties with whom Sapotek has formal agreements (consultants, subcontractors, etc.) and to parties who may have access to data that is covered by this Policy, including partners, vendors, agents or other related parties.

Information Collected by Sapotek
While Sapotek does not ask for detailed personal information, such as your name, home address or phone number, we do ask for basic demographic information, like your general location, gender, birth date, and other identifiers such as your e-mail address when you sign up for Services. It is also probable that you will add detailed personal information about yourself and others (name, home address, work address, phone number, etc.) to the Address Book or other applications contained within Services. We therefore refer to any and all of the information that can or may be used to identify you as “Personal Information.”

Your Personal Information is Safe and Confidential
Sapotek does not share your Personal Information and it will never, ever be published, unless you agree to its publication beforehand. And, of course, your account is password protected. We also have numerous safeguards in place, all of which are in full compliance with local, state, federal and international regulations to protect your Personal Information.

Reasons for Disclosure of Personal Information
Under certain circumstances, Sapotek may disclose your Personal Information to third parties for the following reasons:

  • Legal Obligations – in response to a court order or subpoena, warrant, audit, or agency action, or to establish or exercise our legal rights or defend against legal claims;


  • To Prevent Fraud or other Illegal Activities – fraud has become commonplace on the Internet and, as more and more people use the Internet, there are unfortunately those among us who hope to profit by engaging in fraudulent, illegal or unethical practices. Sapotek will therefore actively cooperate with any law enforcement agencies or other relevant entities in order to prevent, or take action against, illegal activities or threats, fraud or as otherwise required by law;


  • In relation to a Business Transaction – Sapotek may use the basic demographic information you entered when signing up for one of our service (but not detailed Personal Information) in the context of a liquidation event such as a merger, acquisition, consolidation, or divestiture. However, your information will remain confidential and will be governed by confidentiality and other non-disclosure agreements, in keeping with industry practices.


  • How Sapotek Uses your Information
    Sapotek may use your Personal Information for the following purposes:

  • Create Statistics and Reports – So that we have an idea of who is using our services, we may generate statistics and reports that relate to user location, gender, age and usage patterns.


  • Sponsorship or Promotions – Sapotek may use your information to contact you directly, customize content, answer your questions or concerns or in relation to sponsorship and/or promotional activities (this would be basic demographic information, not detailed Personal Information). For example, a sponsor may want access to a certain demographic among our users – women between the ages of 18 and 34 in the New York, Tri-State region. In such cases, we will not provide Personal Information to the sponsor nor will the sponsor contact you directly (Sapotek is always the intermediary), but the sponsor will be aware that you (and others) fall within the criteria specified.


  • Direct Contact – We may also contact you for any reason that relates to your usage of our services, updates to our services or general information about Sapotek or other parties, but you will be contacted directly by Sapotek and your information will remain private and confidential.


  • Cookies – Sapotek may use cookies on your computer. Please bear in mind that most browsers and anti-spyware programs make it possible to clear or reject cookies on your browser. While cookies are not required when using our products or services, you may want to allow for cookies when using our services in order to save time and increase efficiency.


  • Message Boards, Chat Rooms and other forms of Public Communication
    Please bear in mind that many Services developed by Sapotek, such as E-Mail, Instant Messenger, Live Chat and Message Boards and other Services, are forms of public communication or allow for document collaboration and sharing of Personal Information. When you engage in any of these activities, you are consenting to the publication of information about you, which may include your Personal Information. We therefore urge you to use good judgment and discretion when disclosing your Personal Information or engaging in public communication. And be aware as well that we will monitor public information and, in our discretion, take whatever steps are necessary, including removing information or deactivating accounts, in order to protect the integrity of our Services and our users.

    Children
    It is our policy to not allow children under the age of 13 to sign up for our Services. Of course, it is always possible that children may fabricate their ages in order to gain access to our Services. If we suspect that a child is indeed using our Services, we will do our utmost to discern the truth about a user’s age and take whatever appropriate action (deactivating an account, if need be) necessary to address the situation.

    Should we ever decide to allow children to sign up for our Services, we will create content and Services appropriate to a child and in accordance with the Children's Online Privacy Protection Act. We will also allow for parental control over those accounts so that they are the ultimate decision makers regarding their children’s use of our Services.

    Editing your Personal Information
    You can always access, edit or update your Personal Information at any time once you have signed up for one of our Services.

    Changes to this Policy
    Sapotek may update this policy at any time and, if we do, we will let you know of any material changes (we won’t bother you with incomprehensible legal jargon).

    This Policy is dated June 15, 2006.
